| A Work Permit will
be issued for a particular person to do a particular
job for a specified period of time. |

The Work Permit category encompasses a wide variety
of occupations, however some are considered in critical
short supply and termed
Shortage Occupations, and these have been noted by
the relevant UK professional bodies as being in chronic
need within the UK.
The Work Permit scheme does not extend to all types
of employment. It is restricted to what might be referred
to as professional , executive or highly skilled posts
and therefore excludes unskilled
and semiskilled employment.
A Work Permit does not constitute a contract of employment
between the Permit holder and the Employer, nor does the
issue of a Permit constitute any obligation upon the Immigration
Officer to give the holder leave
to enter the United Kingdom.
Therefore, on no account
should a candidate be advised to make travel arrangements
or travel to the UK without the necessary Work
Permit (and
UK Entry Clearance if necessary) having first been
issued.

| Work
Permits are normally only issued for persons who have
EITHER of the following: |
| Possess a UK equivalent
degree qualification; or |
| Possess a Higher
National Diploma (HND) level occupational qualification
which is relevant to the post on offer; or |
| Possess a Higher
National Diploma HND level qualification which is
not relevant to the post on offer; plus one year's
relevant work experience . |
| For some professions
(e.g.: doctors, dentists and nurses) where the employee
needs to be registered with the appropriate UK Professional
Organisations (e.g. GMC, UKCC, GDC, RCVS) the candidate
registration number can be accepted as proof
that the individual meets the qualifying criteria. |
Where
none of the above qualifications are possessed,
the overseas national will need to have a minimum requirement
of 3 years relevant
experience at NVQ level 3 in high level specialist
skills acquired through doing the type of job for
which the permit is being sought.
Those who would qualify include:
- head or second chefs
- specialist chefs with skills in preparing ethnic
cuisine
- and those with occupational skills and language
or cultural skills NOT readily
available in the EEA.
NOTE: The list above
is just a guideline and there are exceptions.

You will also need to submit statements (original may
be required later) from past employers on their headed
notepaper that verify the candidate's work experience.
Statements that only describe the person to be of good
character will NOT surfice.
Statements must give the start and finish dates,
details of the work role and any experience that makes
the person qualified to do the job, and if the documents
required are not in English you will also need to include
a translation.

| PAYE
and NATIONAL INSURANCE |
You
will normally be expected to operate PAYE and CLASS
1 NATIONAL INSURANCE contributions.
Payments made via an overseas service company or
a third party (whose main involvement with the
worker is to hire the workers services to others )
will NOT normally be appropriate.
Work Permits are normally only issued where there
is a direct contract of employment between the
person and their employer - a company based in Great Britain. |
